ONELIFE FITNESS PRIVACY POLICY

This is the privacy policy (“Privacy Policy”) that governs how US Fitness Holdings, LLC (d/b/a Onelife Fitness) and its affiliated companies (“Onelife Fitness”, “we”, “our” or “us”) use Personal Information (defined below) of our consumers, members, guests, or users of our Service. This Privacy Policy applies to our websites including www.onelifefitness.com and any other website we operate that links to this Privacy Policy (collectively, our “Sites”), our mobile application (our “App”), and all software, services, extensions, subdomains, and application programming interfaces related thereto (collectively, our “Service”). This policy does not govern information we collect about employees or contractors in the course of the employment relationship.

Onelife Fitness makes its Service available to individuals (“user”, “you”, or “your”) to support personal training and exercise scheduling, access, and management. Please read this Privacy Policy carefully to better understand how we collect, use, and disclose Personal Information about you as you use our Service.

1. INTRODUCTION
We are committed to respecting privacy and recognize the need for appropriate protection and management of any Personal Information that is shared with us as part of using our Service. As used in this Privacy Policy, “Personal Information” means any information relating to an identified or identifiable natural person. We may collect Personal Information from you directly, or indirectly through automated means, as discussed more fully in Sections 3 and 4, below.
You may choose whether or not to provide or disclose Personal Information in connection with your use of our Service. If you choose not to provide the Personal Information we request, you may still visit and use parts of our Service but may be unable to access or use certain features, options, programs, products, and services.

Our Service may contain links to third-party websites, products, services, and advertisements that are not owned or controlled by Onelife Fitness. We are not responsible for the privacy practices or the content of those third-party websites, products, services, and advertisements, and you visit them at your own risk.

2. CATEGORIES OF PERSONAL INFORMATION WE COLLECT
We and our service providers may collect, and you may consent to provide, the categories of Personal Information set forth below in order to provide our Service to you, or because we are legally required to do so:
• Name
• Email address
• Address
• Location
• Payment information
• Age
• Gender
• Phone number
• User name
• Public forum information
• Communications you send to us

• Driver’s license number or other government-issued identifier, where collected (such as in connection with guest passes or age verification)

• Signature, including signatures on membership agreements, waivers, and billing authorizations

• Membership and usage information, such as your membership ID, the clubs you visit and the times you check in, classes booked, training sessions and other services purchased, and transaction history

• Physical characteristics and descriptions, such as height, weight and similar measurements in connection with fitness assessments
• Health and wellness information (such as health conditions, fitness assessments, biometric measurements, body composition data, and information shared with personal trainers or nutritionists)
• Fitness and exercise activity data (such as heart rate, training data, and similar metrics)
• Emergency contact information
• Images, audio recordings, and video (such as security camera footage at our facilities and photographs or recordings collected for marketing or program purposes)
• Geolocation information collected through our App when you grant permission
• License plate number, where applicable, in connection with parking at our facilities

 

3. WHEN PERSONAL INFORMATION IS COLLECTED
Onelife Fitness collects certain information that may constitute Personal Information in the following ways:

(a) Contact Information
In various areas of our Service and in printed materials, we provide you the opportunity to submit a form with basic contact information, such as your name, email, or mailing address. With your permission, Onelife Fitness uses such information to inform you of new products, technical information and services, and upcoming events that may be of interest. If you no longer wish to receive these emails, the opt-out process is described in Section 11 of this Privacy Policy. In addition, if you choose, you may participate in a Onelife Fitness e-mail list server by subscribing within our Service or by contacting Onelife Fitness staff directly. You may unsubscribe from these e-mail list servers by following the unsubscribe instructions found within the list email.

(b) Service Login Information
We process the username and password of users to enable secure logging into our Service, and we process information regarding your role to appropriately control access to restricted content. We process this Personal Information only as necessary to provide our Service under our Terms of Useand to further our legitimate interests in protecting our Service and content.

(c) Payment Information
When you purchase services or products from us, third-party service providers acting on our behalf process payment information, including payment card details and billing and shipping addresses, to help us fulfill your orders. Any Personal Information collected by such third parties will be subject to the third parties’ privacy policy, rather than this Privacy Policy.

(d) Personal Information Collected by Third Parties
Please note that we use certain third-party service providers on our Service to enhance your experience or deliver certain services. These providers may collect Personal Information about you in performing their services and/or functions on our Service. Please review Section 6(a) of this Privacy Policy for more details about how we use third parties on our Service.

(e) Application for Employment
Our Service allows users to submit an application for employment at https://careers.onelifefitness.com/us/en. If you submit an application for employment, we provide the opportunity for you to submit some or all of the Personal Information listed in Section 2, above. We have a legitimate interest in this information so that we may process your application in accordance with our internal hiring practices. This information ensures we can contact you and comply with applicable employment law. You may consent, but are not required, to submit additional categories of Personal Information as part of the application process.

(f) Document Submissions
Our Service may allow users to upload documents relating to their application for employment (namely, a resume and cover letter). If you choose to submit documents of this nature, you may disclose certain Personal Information through our Service as a product of your submission. OnelifeFitness uses commercially reasonable efforts to ensure the appropriate administrative, physical, and technical safeguards are in place as it relates to the Personal Information you provide through our Service as part of any document submission.

(g) Social Media
We have worked with certain third-party social media providers to offer you their social networking services through our Service. For example, you can use third-party social networking services to share information about your experience on our Service with your friends and followers on those social networking services. These social networking services may be able to collect information about you, including your activity on our Service. These third-party social networking services also may notify your friends, both on our Service and on the social networking services themselves, that you are a user of our Service or about your use of our Service, in accordance with applicable law and their own privacy policies. If you choose to access or make use of third-party social networking services, we may receive information about you that you have made available to those social networking services. If you link your account from a third-party site or service, we may collect information from those third-party accounts, and any information that we collect will be governed by this Privacy Policy.

(h) Health and Wellness Information
If you participate in personal training, fitness assessments, body composition or biometric measurements, nutrition consultations, or similar services, or if you share fitness or exercise data with us through our App or connected devices, we may collect health and wellness information about you. We use this information to provide and personalize the services you have requested, and we do not sell this information or use it for cross-context behavioral advertising.

(i) Geolocation Information
Our App or websites may request permission to access your device’s location to provide location-specific features such as club hours, class schedules, and in-club promotions. If you consent, we may use GPS, your device’s IP address, Wi-Fi, or other technologies to determine your location. You may revoke this permission at any time through your device settings. If you disable location services, certain features of the App may not function as intended.

(j) On-Premises Recordings
Our facilities, including parking areas managed by us or our landlords, may use security cameras and other recording technologies for safety, security, loss prevention, and operational purposes. We may also collect images, audio, or video in connection with marketing, programs, classes, or events, where permitted by law. Where required, we will provide notice or obtain consent before collecting such recordings. If our parking facilities use license plate recognition, we may collect and process license plate numbers in connection with parking access and enforcement.

4. INFORMATION COLLECTED AUTOMATICALLY
Certain information on our Service is collected automatically by means of various software tools. We have a legitimate interest in using such information to assist in log-in, systems administration purposes, information security and abuse prevention, to track user trends, and to analyze the effectiveness of our Service.

(a) Log Files
The information inside the log files includes internet protocol (“IP”) addresses, type of browser, Internet Service Provider (“ISP”), date/time stamp, referring/exit pages, clicked pages and any other information your browser may send to us.

(b) Cookies

We and authorized third parties use cookies, pixels, tags, scripts, software development kits (SDKs), and similar technologies (collectively, “Cookies”) to collect information about you, your device, and how you interact with our Service.

 

Types of Cookies. We use both first-party Cookies (set by us) and third-party Cookies (set by other parties). Some Cookies last only during your browsing session and are deleted when you close your browser; others persist after you close your browser.

Purposes for Using Cookies. We and authorized third parties use Cookies for the following purposes:

  • Strictly Necessary, such as determining when you are signed in, providing privacy choices, and security purposes including fraud prevention;
  • Functionality and Personalization, such as remembering language preferences and recently viewed pages to enhance your experience;
  • Performance and Analytics, such as understanding how visitors use our Service so we can improve it (for example, through Google Analytics);
  • Targeting, Advertising, and Personalized Messaging, such as personalizing advertising and communications based on your interests and activity, delivering content and messaging relevant to your fitness goals and engagement with our Service, measuring advertising and communications effectiveness, and identifying how you engage with our communications, including across devices.
  • The right to know or access the Personal Information we have collected about you, including the categories of Personal Information collected, the categories of sources, the business or commercial purposes for collecting or sharing it, and the categories of third parties to whom it has been disclosed;
  • The right to request that we correct inaccurate Personal Information;
  • The right to request that we delete Personal Information we have collected from you, subject to exceptions permitted by law;
  • The right to data portability, where applicable;
  • The right to opt out of the sale or sharing of your Personal Information for targeted advertising;
  • The right to limit the use or disclosure of sensitive Personal Information; and
  • The right to non-discrimination for exercising these rights.

Your Choices. You may be able to control how Cookies are used through your browser settings, your device settings, and industry opt-out mechanisms such as those offered by the Digital Advertising Alliance (https://youradchoices.com) and the Network Advertising Initiative (https://optout.networkadvertising.org). Disabling Cookies may impact the functionality of our Service.

(c) Analytics Service
We may use certain third-party analytics services to improve the functionality, features, or delivery of our Service. We may also use these analytics services to record mouse clicks, mouse movements, scrolling activity, as well as any text that you type into our Service. For example, we use Google Analytics on our Service to track user trends and usage. For more information on Google Analytics’ processing of Personal Information as it relates to our Service, please see http://www.google.com/policies/privacy/partners/. By using a browser plugin provided by Google, you can opt out of Google Analytics.

(d) Other Tracking Technologies
When you visit our Service, we may collect your IP address for certain purposes such as, for example, to monitor the regions from which you navigate our Service. We may also use web beacons alone or in conjunction with cookies to compile information about your usage of our Service and interaction with emails from us. Web beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular site tied to the web beacon. We may use web beacons to operate and improve our Service.

5. THE PURPOSES FOR WHICH WE USE PERSONAL INFORMATION
If you submit or we collect Personal Information through our Service, then such Personal Information may be used to:
• Provide, analyze, administer, improve, and personalize the Service;
• Contact you in connection with the Service, notifications, events, programs or offerings that you may have registered for;
• Send you updates and promotional materials;
• Provide personalized advertising, content and communications to you which may be relevant to your activities and interests;
• Identify and authenticate your access to the parts of the Service that you are authorized to access;
• For recruiting and human resources administration purposes; and
• Protect our rights and/or our property and to ensure the technical functionality and security of the Service.

Sensitive Personal Information. Certain categories of Personal Information we collect may be considered “sensitive” under applicable state privacy laws, including driver’s license number, precise geolocation, and information about your health (such as biometric measurements, body composition data, and fitness assessment results). We use and disclose Sensitive Personal Information only for the following purposes: (i) to provide the Service or product you have requested; (ii) to detect security incidents and protect against malicious, deceptive, fraudulent, or illegal activity; (iii) to ensure the physical safety of individuals; (iv) for short-term, transient use, such as non-personalized advertising; (v) to perform internal business services; (vi) to verify or maintain the quality or safety of our Service; or (vii) for purposes that do not infer characteristics about you.

6. HOW WE DISCLOSE PERSONAL INFORMATION
We do not sell, lease, rent or otherwise disclose the Personal Information collected from our Service to third parties unless otherwise stated below or with your consent. We do not “sell” Personal Information for monetary consideration. We may “share” Personal Information for cross-context behavioral advertising as those terms are defined under applicable state law, and you may opt out by contacting us as described in Section 10.

(a) Our Third Party Providers
We transfer Personal Information to our third-party service providers to perform tasks on our behalf and to assist us in providing our Service. For example, we may share your Personal Information with service providers who assist us in performing core functions (such as hosting, data storage, and security) related to our operation of the Service and/or by making certain interactive tools available to you as a user. We also use third parties for technical and customer support, application development, tracking and reporting functions, quality assurance, and other Service. In the performance of our Service, we may share Personal Information from or about you with these third parties so that we can deliver the highest quality user experience. We use commercially reasonable efforts to only engage with third parties that post a publicly available privacy policy.

(b) Advertisers
From time-to-time, we engage advertising services to assist us in advertising our brand and Service. Those services may target advertisements on third-party websites based on cookies or other information indicating previous interaction with our Service.

(c) Aggregate Information
To better serve our users, business partners, and to improve our Service, Onelife Fitness may conduct research on user demographics, interests and behavior based on the Personal Information and other information provided to Onelife Fitness. This research may be compiled and analyzed on an anonymous, aggregate basis, and we may share this aggregated information with our affiliates, agents and business partners. This aggregate information does not identify a user personally. Onelife Fitness may also disclose aggregated information in order to describe our Service to current and prospective business partners and to other third parties for other lawful purposes.

(d) Business Partners
From time-to-time, we may partner with other companies to jointly offer products or services. If you purchase or specifically express interest in a jointly offered product or service from us, we may share Personal Information collected in connection with your purchase or expression of interest with our joint promotion partner(s). We do not control our business partners’ use of Personal Information we collect, and their use of the information will be in accordance with their independent privacy policies.

(e) In the Event of Merger, Sale, or Change of Control
We may transfer or assign this Privacy Policy and any Personal Information to a third-party entity that acquires or is merged with us as part of a merger, acquisition, sale, or other change of control (for example, a bankruptcy proceeding).

(f) Other Disclosures
We may disclose Personal Information about you if we have a good faith belief that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our Terms of Use, including investigations of potential violations thereof; (iii) detect, prevent, or otherwise address fraud or security issues; or (iv) protect against harm to the rights, property or safety of Onelife Fitness, our users, or the public.

7. RETENTION OF PERSONAL INFORMATION
We reserve the right to retain any Personal Information as long as the Personal Information are needed to: (i) fulfill the purposes that are described in Section 5, and (ii) comply with applicable law.

8. DATA SECURITY
The privacy and security of Personal Information is very important to us. Taking into account the nature, scope, context and purposes of processing Personal Information, Onelife Fitness has implemented appropriate technical and organizational measures to ensure and to be able to demonstratethat its processing of Personal Information is performed in accordance with applicable law. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, while we strive to use commercially acceptable means to protect Personal Information, we cannot guarantee its absolute security.

9. CHILDREN’S PRIVACY
Membership and Minors. Onelife Fitness offers membership to individuals who are at least fourteen (14) years of age. For members under the age of eighteen (18), a parent or legal guardian must sign the membership agreement on the minor’s behalf and provide consent to the collection, use, and disclosure of the minor’s Personal Information as described in this Privacy Policy. By providing such consent, the parent or legal guardian represents that they have the legal authority to consent on the minor’s behalf.

We do not knowingly collect Personal Information online from children under the age of thirteen (13), except as described below in connection with our on-site childcare services. If you believe we have collected Personal Information from a child under thirteen (13) outside of those services, please contact us at admin@onelifefitness.com and we will take prompt steps to delete it.

Minors’ Data. For members under the age of eighteen (18), we do not use Personal Information for targeted advertising or sell Personal Information without separate consent from the parent or legal guardian as required by applicable law. Parents and legal guardians may, at any time, review the Personal Information we have collected about their minor child, request correction or deletion of such information, or withdraw consent to its further processing, by contacting us at admin@onelifefitness.com.

On-Site Childcare. Some of our facilities offer on-site childcare. In connection with this service, a parent or legal guardian may provide Personal Information about a child under thirteen (13), such as the child's name, age, allergy and medical alert information, emergency contacts, and pick-up authorizations. We collect this information only from the parent or guardian and use it only to provide the childcare service. We do not use it to market to children, sell it, or share it for cross-context behavioral advertising.

Parental Rights. Parents and legal guardians may, at any time, review, delete, or request that we stop collecting their child's Personal Information by contacting the childcare staff at their home club or emailing admin@onelifefitness.com.

Incidental Collection. Children at our facilities may appear in security camera footage as described in Section 3(j). We do not use these recordings to identify individual children except for safety, security, or operational purposes.

If we learn that we have collected Personal Information from a child under thirteen (13) outside of on-site childcare, we will promptly delete it.

10. YOUR PRIVACY RIGHTS AND CHOICES
Depending on where you reside, you may have certain rights under applicable U.S. state privacy laws, including those of California, Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia, and other states to the extent they enact similar privacy laws. To exercise any of these rights, please contact us at admin@onelifefitness.com. We will respond to your request within the time period required by applicable law. We may need to verify your identity before fulfilling your request, and we may decline a request where permitted by law.

Limits on Opting Out. Opting out of marketing or targeted advertising does not stop transactional and operational messages necessary to provide the Service (such as billing, account, scheduling, and safety communications). Some Service features may also be unavailable if you opt out of processing necessary to deliver them.

Authorized Agents

You may designate an authorized agent to submit a request on your behalf. We may require proof of the agent’s authority and may also ask you to verify your identity directly.


Right to Appeal

If we decline your request, you may have the right to appeal our decision. To submit an appeal, contact us at admin@onelifefitness.com.

Mobile Information

We do not sell or share mobile information or text messaging opt-in data and consent with third parties.

Washington Consumer Health Data
If you are a resident of Washington, you may have additional rights under Washington's My Health My Data Act with respect to consumer health data we collect about you, including the right to provide or withhold consent regarding the collection and sharing of your consumer health data, the right to access and delete that data, and the right to withdraw your consent. Financial Incentive Notice
From time to time, we may offer financial incentives (as defined under the California Consumer Privacy Act) such as discounts, coupons, sweepstakes entries, contests, or promotional offers in exchange for the collection or retention of certain Personal Information. The applicable program will describe the Personal Information collected, the benefit provided, how to opt in and opt out, and our good-faith estimate of the value of the Personal Information to us. The value is generally calculated based on the expense related to providing the benefit. Participation is always optional, and you can withdraw at any time as described in the applicable program terms.

11. EMAIL COMMUNICATIONS AND COMMUNICATION VIA TEXTS
You may choose not to receive future promotional or advertising emails from us by selecting an unsubscribe link at the bottom of each email that you receive from us. Additionally, you may send a request specifying your communications preferences to admin@onelifefitness.com. You cannot opt out of receiving transactional emails related to the performance of our services. Please note that even if you opt out of receiving the foregoing emails, we may still send you a response to any “Contact” request as well as administrative, maintenance and operational emails (for example, in connection with a password reset request).

If you provide your mobile phone number and opt in to receive text messages from us, we collect your phone number and the categories of Personal Information described in Section 2 above. We use this information for the purposes described in Section 5 above, including to send you account, scheduling, and transactional messages and, where you have consented, promotional messages about our Service. Mobile information and opt-in consent will not be shared with third parties or affiliates for marketing or promotional purposes. Message frequency may vary. Message and data rates may apply. Reply HELP for help or STOP to opt-out at any time. Carriers are not liable for any delayed or undelivered messages. Additional terms governing our SMS program are set forth in our Terms of Use.

12. SPECIAL NOTE TO INTERNATIONAL USERS
The Service is hosted in the United States and is intended for and directed to users in the United States. If you are accessing the Service from the European Union, Asia, or any other region with laws or regulations governing Personal Information collection, use, and disclosure, that differ from United States laws, please be advised that your continued use of the Service will be governed by United States law, this Privacy Policy, and our Terms of Use. Information about you that we collect or that you submit may be transferred to, processed in, and held in countries other than the one in which you reside, including countries such as the United States, which the European Union has deemed do not provide “adequate” protection for Personal Information.

13. CHANGES TO THIS PRIVACY POLICY
As our organization changes over time, this Privacy Policy is expected to change as well. We reserve the right to amend the Privacy Policy at any time, for any reason, without notice to you, other than the posting of the amended Privacy Policy on our Service. We may e-mail periodic reminders of our notices and terms and conditions, but you should check our Service frequently to see the current Privacy Policy that is in effect and any changes that may have been made to it.
